Terms & Conditions
The application "FitWiz" and the website www.fitwiz.app are currently operated by Faisal Hasan under the FitWiz name. The app and related services are being developed in preparation for transition to a future incorporated entity that will manage FitWiz operations.
Once incorporated, all rights and obligations under these Terms will automatically transfer to the new entity without requiring additional consent from users.

1. Acceptance of Terms
By downloading, accessing, or using the FitWiz application ('App') or website ('Services'), you agree to be bound by these Terms & Conditions ('Terms'). If you do not agree to these Terms, please do not use our Services.
2. Changes to Terms
We may update these Terms from time to time to reflect changes in our Services or legal requirements. When we make material changes, we will notify you through the App or via email. Your continued use of FitWiz after changes become effective means you accept the revised Terms. The most current version will always be available on our website at fitwiz.app/terms.
3. Eligibility
You must be at least 13 years old (or the minimum legal age in your jurisdiction, whichever is higher) to use FitWiz. If you are under 18, you represent that you have your parent’s or guardian’s permission to use the Services. You are responsible for maintaining the accuracy and security of your account information.
4. Account Registration & Authentication
You may create an account using your email and password (with OTP verification) or through third-party authentication (Apple ID, Google, or Facebook). By using third-party authentication, you authorize us to collect basic information necessary to create and maintain your account. You are responsible for maintaining the confidentiality of your login credentials.
5. Acceptable Use
You agree not to misuse FitWiz. You will not:

Use the Services in violation of any applicable laws

Interfere with or disrupt our systems

Access data or accounts without authorization

Copy, reverse-engineer, or redistribute the App

Upload harmful or malicious content

Impersonate others or misrepresent your affiliation
6. Fitness & Health Disclaimer
FitWiz provides general fitness guidance and tracking tools only. It does not provide medical advice, diagnosis, or treatment. Always consult healthcare professionals before beginning any exercise program. Exercise at your own risk.
7. Trainer Features & Responsibilities
If you use FitWiz as a trainer, you are responsible for the accuracy, safety, and appropriateness of all workouts you create. You must comply with professional standards and may not provide medical advice unless properly licensed. Content submitted to FitWiz’s public library may be reviewed for formatting consistency but not safety validation.
8. Trainer–Client Relationships
Trainer–client connections and data sharing occur only with mutual consent within the FitWiz platform. Trainers can view client workout data (exercises, sets, reps, and progress) but not Apple Health data. All professional obligations and liabilities remain between trainer and client; FitWiz does not mediate disputes.
9. Beta Version Disclaimer
FitWiz is currently released as a Beta version. Some features may be incomplete or may change without notice.
By using the Beta version, you acknowledge and agree that performance, availability, and data reliability may vary during this phase.
FitWiz is currently provided for evaluation and testing purposes only, and we are not liable for any temporary interruptions, errors, or loss of data that may occur while using the Beta version.
10. Third-Party Integrations
FitWiz currently integrates with Apple HealthKit only. Other integrations (Google Fit, Fitbit, Garmin, etc.) may be added later with user consent. We are not responsible for the availability or accuracy of third-party services.
11. Data Privacy & Cloud Storage
FitWiz stores user and trainer data securely in the cloud using encryption and access controls. Apple HealthKit data is synchronized only for workout correlation and not shared with trainers. Use of your data is governed by our Privacy Policy at fitwiz.app/privacy.
12. Subscriptions, Payments & Billing
Subscriptions are processed through the Apple App Store or Google Play Store. Web payments (future) will be processed securely through Stripe. Subscriptions renew automatically unless cancelled. Manage renewals through your App Store/Google Play account. Refunds are governed by the respective payment platform’s policy.
13. International Data Transfers
Your data may be processed or stored outside your country of residence. We implement safeguards such as standard contractual clauses to protect your data.
14. Service Availability
We strive for consistent availability but cannot guarantee uninterrupted service. Maintenance, updates, or outages may temporarily affect access.
During the Beta phase, service uptime and feature behavior may vary as we continue to test and enhance the platform.
15. Account Termination
You may delete your account at any time. FitWiz may suspend or terminate accounts that violate these Terms.
16. Disclaimers & Limitation of Liability
Services are provided 'AS IS' and 'AS AVAILABLE'. We make no warranties regarding accuracy, reliability, or suitability. To the fullest extent permitted by law, FitWiz shall not be liable for indirect, incidental, or consequential damages.
17. Indemnification
You agree to indemnify and hold FitWiz harmless from any claims or expenses arising from your use of the Services or violation of these Terms.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws applicable in the jurisdiction where FitWiz is legally established. Any disputes arising in connection with these Terms shall be resolved through confidential arbitration under the applicable local rules of that jurisdiction.
19. Force Majeure
FitWiz is not liable for delays or failures caused by events beyond reasonable control, including natural disasters, cyberattacks, or technical failures.
20. Entire Agreement
These Terms, along with the Privacy Policy, constitute the entire agreement between you and FitWiz regarding use of the Services.
